Terms & Conditions

These Terms & Conditions govern the sale of products through HossiShop (hossishop.com). By placing an order, you agree to be bound by these terms. Please read them carefully before purchasing.

HossiShop operates as a sole-proprietorship business under the personal fiscal code of its owner, in accordance with Italian law for non-VAT-registered occasional commercial activity. Italian invoicing rules (Codice Civile and applicable tax law) apply.

2. Acceptance of Terms

By placing an order on HossiShop, you confirm that:

• You are at least 18 years old, or have legal guardian consent to make purchases.
• You have read, understood, and accepted these Terms & Conditions, our Privacy Policy, and our Returns & Refunds Policy.
• The information you provide is accurate, current, and complete.

If you do not agree with any part of these terms, do not place an order.

3. Products & Availability

All products listed on HossiShop are subject to availability. We curate worldwide essentials from a global fulfillment network of trusted supplier partners. We make every reasonable effort to display products accurately, including:

• Product images and color representations (note: actual colors may vary slightly due to monitor settings).
• Product descriptions, dimensions, and specifications.
• Available variants (size, color, etc.).

Stock levels are updated regularly but are not guaranteed in real time. If a product becomes unavailable after you place an order, we will notify you and offer a full refund or an equivalent alternative.

4. Prices & Currency

All prices on HossiShop are listed in Euro (EUR). The displayed price is the total amount the customer pays — there are no hidden fees, surcharges, or additional taxes at checkout.

Because HossiShop currently operates as a non-VAT-registered sole proprietorship under Italian law, no VAT (IVA) is charged on the displayed price.

Shipping fees are calculated separately at checkout based on the destination zone — see Section 7 below.

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the moment your order is confirmed.

In accordance with EU Directive 2019/2161 (Omnibus Directive), implemented in Italy by D.Lgs. 26/2023, any "discount" or "reduced from" price displayed will reference the lowest price applied during the 30 days preceding the promotion.

5. Ordering Process

1. Browse and select: add products to your cart.
2. Cart review: review item, quantity, and subtotal.
3. Checkout: enter shipping and billing information.
4. Payment: complete payment through Stripe.
5. Order confirmation: you will receive a confirmation email at the address you provided.
6. Fulfillment: your order is processed and dispatched from our global fulfillment network.
7. Tracking: a shipment notification with tracking link is emailed once dispatched.

A contract of sale is formed only when we send you the order confirmation email. We reserve the right to refuse or cancel any order for reasons including, but not limited to: stock unavailability, pricing errors, suspected fraud, or unverified payment.

6. Payment

Payments are processed exclusively through Stripe Payments Europe Ltd., a PCI-DSS Level 1 certified payment provider. We accept the following payment methods:

• American Express
• Apple Pay
• Google Pay
• Other major debit/credit cards supported by Stripe

We do not store your full card details on our servers. All payment data is encrypted and handled directly by Stripe in accordance with PCI-DSS standards.

If your payment is declined, your order will not be processed. Please verify your payment details and try again, or contact your card issuer.

7. Shipping & Delivery

We ship worldwide. Shipping costs and estimated delivery times depend on the destination zone:

Customers outside the European Union may be subject to customs duties or import taxes upon arrival. These are the customer's sole responsibility and are not included in the displayed price or shipping fee.

8. Right of Withdrawal & Returns

HossiShop offers two complementary return policies:

30-day goodwill returns

You may return any product within 30 days of delivery for any reason, provided the product is unused, in original packaging, and with tags attached. This is our voluntary goodwill promise beyond the legal minimum.

14-day Diritto di Recesso (EU legal minimum)

Under Italian Codice del Consumo Articles 52-59 (D.Lgs. 21/2014 implementing Directive 2011/83/EU), EU consumers have a statutory right to withdraw from a distance-sales contract within 14 days of receiving the product, without giving any reason and without penalty (except return shipping costs).

To exercise your right of withdrawal, contact support@hossishop.com within the 14-day period. You will receive a Return Merchandise Authorization (RMA) and return instructions. Refunds are issued within 14 days of our receipt of the returned product, to your original payment method.

9. Warranty & Consumer Rights

All products sold to consumers within the European Union are covered by the 2-year legal warranty of conformity (garanzia legale di conformità) under Italian Codice del Consumo Articles 128-135 (D.Lgs. 206/2005, as amended by D.Lgs. 170/2021 implementing Directive 2019/771).

This means if a product is defective, not as described, or does not meet reasonable quality expectations, you are entitled to:

• Repair or replacement (at our cost);
• A price reduction; or
• A full refund if repair/replacement is not feasible.

To make a warranty claim, contact support@hossishop.com within 2 months of discovering the defect.

10. Limitation of Liability

To the maximum extent permitted by applicable law, HossiShop's liability for any claim arising from these terms or from the purchase of products is limited to the price paid for the relevant product.

HossiShop is not liable for indirect, incidental, consequential, or punitive damages, including loss of profit, loss of data, or business interruption.

Nothing in these terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under Italian and EU consumer law.

11. Force Majeure

HossiShop is not liable for any delay or failure to perform its obligations caused by events beyond its reasonable control, including but not limited to: natural disasters, pandemics, government restrictions, labor strikes, transportation disruptions, supplier failures, war, terrorism, or critical IT infrastructure failures.

In such cases, we will notify you as soon as reasonably possible and offer either a delivery delay or a full refund, at your choice.

12. Intellectual Property

All content on HossiShop — including the brand name, logo, text, graphics, product photographs, design, and software — is the intellectual property of HossiShop or its licensors, and is protected under Italian and international copyright, trademark, and trade-secret laws.

You may not reproduce, distribute, modify, or create derivative works from any HossiShop content without our prior written consent. Personal, non-commercial use of the site is permitted within the scope necessary to browse and purchase.

13. Privacy

Your personal data is processed in accordance with our Privacy Policy, which is incorporated by reference into these Terms & Conditions. By placing an order, you confirm you have read and accepted our Privacy Policy.

14. Disputes & Jurisdiction

These Terms & Conditions are governed by Italian law. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Venice, Italy — except where mandatory consumer-protection law gives the consumer the right to bring the dispute before the courts of their place of residence within the EU.

Online Dispute Resolution (ODR): EU consumers may use the European Commission's ODR platform to resolve disputes online: ec.europa.eu/consumers/odr.

Before escalating to ODR or court, we encourage you to contact us first at support@hossishop.com. Most disputes can be resolved quickly and amicably through direct communication.

15. Changes to Terms

We reserve the right to update these Terms & Conditions at any time to reflect changes in our practices, services, or legal obligations. The "Last updated" date at the top indicates the latest revision. Material changes will be communicated by email (if you have an account) or via a prominent notice on the homepage. The terms applicable to your order are those in force at the time the order is confirmed.
